The Role of Central Information Commission in Ensuring Access to Information

Access to information is one of the fundamental pillars of democracy. It enables citizens to engage in active participation in the decision-making process and hold governments accountable. However, access to information is often restricted, and it is the role of the Central Information Commission (CIC) to ensure that such rights are protected.

Established under the Right to Information Act, 2005, the Central Information Commission is an independent statutory body responsible for implementing the Act. The primary role of CIC is to adjudicate on complaints and appeals filed against public authorities that deny information or are unresponsive to requests.

The CIC has been instrumental in ensuring transparency and accountability in government activities by enforcing the principles of the Right to Information Act. It has played a critical role in transforming the culture of secrecy that existed in government offices into one of openness and accountability.

One of the significant successes of the CIC has been the proactive disclosure of information. Public authorities are required to disclose a vast amount of information under Section 4 of the Act. However, in the initial stages, there was a lack of compliance by the public authorities. The CIC intervened and directed the authorities to comply with the provisions of Section 4. The result was a significant increase in transparency and accountability because of the proactive disclosure of information.

The CIC has also played a crucial role in protecting whistleblowers. Section 19(3) of the Act provides for the protection of whistleblowers. The CIC has been proactive in ensuring that the provisions of this section are enforced. It has ordered disciplinary action against officials who have victimized whistleblowers.

Similarly, the CIC has made significant contributions in protecting the rights of RTI applicants. It is not uncommon for public authorities to deny information or provide incomplete information. In such cases, the CIC has been swift in directing the authorities to provide the requested information.

Another significant contribution of the CIC has been in reducing the backlog of cases. Cases filed with the CIC are adjudicated within a specific time frame under the Act. The CIC has been successful in reducing the backlog of cases by ensuring that complaints and appeals are disposed of within the stipulated time frame.

The CIC has also been instrumental in promoting a culture of transparency and accountability in the private sector. Private sector entities are not covered under the Act. However, the CIC has used its powers under Section 18 of the Act to issue guidelines to private sector entities to promote transparency and accountability.

In conclusion, the Central Information Commission plays a vital role in ensuring access to information and promoting transparency and accountability. Its contributions have been significant in transforming the culture of secrecy that existed in government offices into one of openness and accountability. The CIC’s proactive intervention in ensuring compliance with the provisions of the Act has resulted in increased transparency, reduced backlog of cases, and protection of whistleblowers and RTI applicants.
